Online poker is certainly one Americas favorite pastimes but with recent developments many Americans still wonder if playing poker on the internet is actually legal or not. I am not a lawyer and also have no legal background but I have inked plenty of research on this topic and also have made my own, personal conclusions.
In 2006, the United States passed the Unlawful Internet Gambling Enforcement Act or UIGEA. The bill was attached to the Safe Ports Act and was overwhelmingly passed into law. This was the work of two US Senators whom desired to end internet gambling inside the United States.
The UIGEA has been a controversial law from the time it passing. In short the law can make it illegal for Banks as well as other financial institutions to knowing process payments for the purpose of gambling from United States residents. The Act excluded lotteries and fantasy sports along with games of skill. Initially it had been considered that poker online would not be effected with the bill as many viewed poker as a skill game. With everything that said, does the UIGEA really make playing online poker illegal? The simple and short response is no. The law applies just to the finance institutions and poker online rooms. Nowhere in regulations should it claim that any person who plays on-line poker is breaking legislation. Nor can it suggest that making deposits and withdraws from poker rooms are illegal. The onus is on the banks and the poker room to follow the law.
So how can some poker rooms still accept USA players? Many the poker room go ahead and take stance that since they're licensed and regulated in countries away from United States and so they don't need to abide with the UIGEA. For this reason they continue to accept existing and new USA poker players. This is a very "grey" area of regulations but hopefully in the near future we will see full unsafe effects of online poker in the United States. Some states have passed bills allowing on-line poker of their state borders. With such progress we hope to view poker regulated in a national level soon.
